Terms and Conditions for FMEOS Services

These terms apply to all FMEOS websites.
FMEOS.COM, FMEOS.PK, FMEOS.NET, FMEOS.ORG, FMEOS.CO.UK
DXPOINT.COM, FMENTERPRISES.NET and All Future websites.

Change of Terms:
FMEOS may revise and update these Terms and conditions from time to time at its sole discretion. FMEOS encourages you to check this page from time to time to take notice of any changes FMEOS has made. Your continued use of the Websites following the posting of revised Terms and conditions means that you accept and agree to the changes. If any modification is unacceptable to you, your only recourse is to terminate this agreement.

SSH Access:
Due to security reasons, this is not given to shared hosting users. In special circumstances, you take on the sole responsibility of the server and agree to pay any fee we see fit in the case of damages through SSH Access as you will have sole SSH Access and are fully responsible for all of SSH and any damage that the server may take.

Criminal Activities:
FMEOS services may not be used for illegal purposes, or in support of illegal activities. FMEOS reserves the right to cooperate with legal authorities and/or injured third parties.

Harm To Others:
You may not use FMEOS service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography, or use FMEOS service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.

Other Illegal Activities
We do not allow adult material (legal or illegal) to be hosted on our servers. The use of the Services to engage in any activities that are determined by FMEOS, in its sole and absolute discretion, to be illegal is prohibited. Such illegal activities include, but are not limited to, storing, posting, displaying, transmitting or otherwise making available Ponzi or pyramid schemes, fraudulently charging credit cards or displaying credit card information of third parties without their consent, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws, and failure to comply with applicable on-line privacy laws. FMEOS will cooperate fully with appropriate law enforcement agencies in connection with any and all illegal activities occurring on or through the Services.

Forgery or impersonation:
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited.
We also require that these be carefully policed and comply with all state (Oregon) and federal (Pakistan, United States or the country in which you reside) law (regardless of where the sites are located). Failure to abide by these laws constitutes spamming and will be subject to our spamming policy. Please review it below, it is quite severe and will be enforced without exception or limits.

ZERO TOLERANCE SPAM POLICY: Use of the FMEOS service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate suspension of the offending FMEOS account. If you signup to FMEOS and any spam originates from your site or if others spam your ref link or if spam can be linked to your website and we receive a complaint about it, your site will be permanently suspended and no refunds offered.

Network disruptions:
Use of the FMEOS service for any activity which affects the ability of other people or systems to use FMEOS Services or the Internet. Any such actions will result in immediate account suspension.

Security:
You are solely responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. We ask that authorization is given to only those that really needed and that they are trusted sources.

SYN / DDoS Attacks:
If your site is attacked (SYN, DDoS or any other type of malicious attack), we reserve the right to terminate your site immediately. These attacks can severely load servers and make the hosting experience for other users on the same server sub-par. FMEOS will NOT refund any monies paid for hosting services if you are DDoS/SYN attacked.

Excessive Use:
FMEOS accounts operate on shared network resources. Excessive use or abuse of these resources by one customer may have a negative impact on all other customers. We have the right to suspend your account if your site is badly written and draining resources. You will be liable for any damage you cause. A refund will be given in the case of suspension without damage for what we see as appropriate.

Scripts:
If you want to use a script of ANY sort (Autosurf, PPC, PTC, PTP or anything else that is a scripted programme), you may not purchase the shared hosting plan. These plans are designed for small file-sharing/picture sharing and are not designed to have resource-intensive scripts run on them. You MUST select VPS or Dedicated server hosting. Some signups will be flagged for review wherein FMEOS will gather information about you and your site. If FMEOS finds that you have been hosting a scripted site on the shared hosting account, your site will be automatically suspended or terminated depending on the circumstances. If you have signed up to host a scripted site on a shared hosting plan and you have not yet received your login details, you will be contacted and alerted to this fact.

Background Running Programs:
We do not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation.

IRC:
We do not allow IRC server, IRC bots, or IRC shells to be operated on our network.

Extra Notes:
FMEOS is not responsible for the restoration of data to a server. We strongly recommend that you keep copies of your data off-site with you for emergency purposes. If hardware failure and data loss occur, you the client are responsible for data restoration. FMEOS shall not be liable for loss of data under any circumstance.

Payments and Fees:
Payment is due on the defined monthly/yearly recurring billing date of each month. Payments that are declined for any reason are subject to a $XXXX fee. A $XXXX late fee will be assessed for accounts that are 1-5 days overdue or less. Service will be interrupted on accounts that reach 1-12 days past due. Service interrupted for nonpayment is subject to the setup fee for that service for reconnection.

SSL Certificates:
It is not the upfront responsibility of FMEOS to ask for correct details when you signup. You should provide the most correct details you can as these details will be used to order SSL certificates from our provider if you have opted to do so. The SSL provider sees it as important to scrutinize the SSL certificates as they are ordered and if you have provided false details, there is a chance you will not receive your certificate as it has failed a security check at the SSL provider level. Identity theft is NOT TOLERATED at FMEOS and any SSL certificates that fail the SSL provider’s security check will be voided and no refunds will be issued as it was a fraudulent transaction, to begin with.

Delinquent Accounts:
FMEOS may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve the Customer of responsibility for the payment of all accrued service fees, or any collection fees.

Slander:
Your website may not be used to slander others. At the same time, you may not slander FMEOS or associated parties.

Limitation of Liability:
FMEOS will not be liable for any direct or indirect damages, including, without limitation, for lost income or profits in any way related to this Agreement.

You expressly agree that the use of the website and related services is at your sole risk. The website, materials and related services are provided on an “as is” and “as available” basis. FMEOS makes no representations or warranties with regard to the website or any materials therein, whether express or implied, arising by law or otherwise, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose or non-infringement or any implied warranty arising out of course of performance, course of dealing or usage of trade. In addition, FMEOS makes no representation that the operation of the website will be uninterrupted or error-free. FMEOS will not be liable for the consequences of any interruptions or errors on the website. It is your responsibility to evaluate the accuracy, completeness or usefulness of any opinion, advice, information or other content or materials provided in connection with or otherwise available through the website. Please seek the advice of professionals, as appropriate, regarding the evaluation of any such opinion, advice, information or other content. Under no circumstance will FMEOS be liable for any loss or damage caused by your reliance on information obtained through the website, other than as required under applicable consumer-protection law. Some jurisdictions do not allow the disclaimer of certain warranties or limitation of certain types of damages, so some of the above disclaimers may not apply to you and nothing contained herein should be construed as excluding or limiting any liability beyond what is permitted under applicable law.

Service Cancellation:
All requests for cancelling any service/services must be made in writing. We ask this is done 7 days beforehand.

Dedicated Server and VPS Server Cancellation:
Service cancellations must be made as outlined below 7 days before the due date. If a service is not cancelled in an applicable manner, a customer’s funding source may be automatically charged for the continuation of the service.

Log in to the FMEOS control panel, click “My Services”, and then click the service details icon. At bottom of the page, click the “Request Cancellation” button for the active service that needs to be cancelled.

VPS and Dedicated servers automatically terminated if you are failed to clear the invoice before or on a due date.

Server Owners:
You are solely responsible for any breaches of security affecting the (VPS or dedicated) servers under your control. If your server is involved in an attack on another server or network, it will be shut down and an immediate investigation will be launched to determine the cause/source of the attack. In such an event, you shall be responsible for the cost to rectify any damage done to your server and any other requirement affected by the security breach.
You must not engage in activities designed to monitor Internet traffic other than your own. This means, that you must not monitor our Internet traffic, nor the Internet traffic of any other entity.

General Provisions:
You agree to comply with all applicable laws regarding the transmission of technical data exported from Pakistan or the country in which you reside. Your correspondence or business dealings with, or participation in promotions of or with parties found on or through the Website, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations applicable to such dealings, are solely between you and such parties. These Terms and Conditions set forth the entire understanding and agreement of the parties as to the subject matter hereof and supersede all prior proposals, discussions or agreements with respect thereto. A printed version of these Terms and Conditions and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relate to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Domains:
We will take the necessary steps to register domain names on your behalf when requested. However, you are responsible for renewing your domain names. We do not take responsibility for failing to renew domain names. If your domain name was registered by us, you must check and take appropriate actions to renew your domain when it is about to expire.

If you are registering or transferring a domain name you must also agree to the Domain Name Registration Agreement.
* Domains shall be renewed at the price displayed on our client area website.
* Domain renewal reminders will be sent in advance of expiration via email to the address stored in your client area.
* Should an expired domain enter the redemption period, the cost of restoring the domain shall be no more than $9000.
* Registrant shall further endeavour to familiarize themselves with the Registrant Rights and Responsibilities applicable while registering gTLDs.

.PK Domains:
We can not register the reserved domains and domains which does not match the compliance criteria of PKNIC (like Pakistan.pk, Webs.pk, Nets.pk, 123.pk, abc.pk etc), so please make sure your domain name is within the PKNIC compliance area or contact us with domain name before ordering so that we can tell you domain is register-able or not. Refund / Return Policy:
FMEOS doesn’t allow refunds or returns on any service (except mention for a particular service). Hosting is paid upfront and is non-refundable unless we so decide. If you have any questions or comments regarding these policies, please contact us.
